Dear Ms. Floriano: In your letter dated June 15, 2010, but received on September 30, 2010, you requested a tariff classification ruling. You submitted samples of an Adult and Child-Sized Robin Hood of Nottingham Costume Set, which are identified as item numbers 11029 and 17031, respectively. The costume set consists of a tunic top, a belt, gauntlets, boot covers, and a hood. GRI 3(b) is applicable when goods are, prima facie, classifiable under two or more headings, and have been put up in sets for retail sale. GRI 3(b) states that the goods “shall be classified as if they consisted of the material or component which gives them their essential character.” In this case, the hunter green tunic top imparts the essential character of the set and is constructed of 100% polyester knitted fabric. The tunic has brown and black bonded fabric sewn around the hem, in a crenellated design, which is meant to resemble leather. The tunic has a loose, visible overlock stitched neck and interior seams, a hook and loop tab closure, and loose, visible overlock stitched and/or visible raw edges. The Adult and Child-Sized costume sets contain the same components and are constructed exactly the same way except for the size. The applicable subheading for the Adult and Child-Sized Robin Hood of Nottingham Costume Set will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other." The rate of duty will be Free. Duty rates are provided for your convenience and are subject to change.
