Dear Ms. Guyer-Martin: In your letter dated April 26, 2010, you requested a tariff classification ruling. Style 8635 is referred to as a “Women’s Sculpt Full Slip” and is a seamless constructed body-supporting garment made of a tightly knit 90% nylon 10% spandex fabric. The snug fitting undergarment is supported on the body by shoulder straps that measure approximately 1½ inches in width and features a V-styled front, elasticized self fabric capping at the arm and neck openings, a hemmed bottom and knit in control panels. The full slip-styled garment extends to the lower thigh area. A change of knit pattern at the bust allows for cupping and support without flattening. According to your submission, the garment is designed for total body sculpting, including trimming the torso and slimming the waist. The applicable subheading for style 8635 will be 6212.90.0030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for brassieres, girdles, corsets, braces, garters and similar articles and parts thereof, whether or not knitted or crocheted: other…of man-made fibers or man-made fibers and rubber or plastics. The duty rate will be 6.6% ad valorem. Duty rates are provided for your convenience and are subject to change.
