Voakes, International Logistics Manager Cooper Standard Automotive, Inc. 39550 Orchard Hill Place Drive Novi, MI 48375 RE: The tariff classification of pipe assemblies from Mexico. Dear Mr. Voakes, In your letter dated April 21, 2010, you requested a tariff classification ruling. The items under consideration have been identified as two (2) Bundled Pipe Assemblies (Part #s 13276455 & 13253292). Each assembly consists of two (2) rear brake lines, a fuel feed line and an emission evaporator line. You state in your ruling request that the parts are used on automotive vehicles equipped with spark-ignition, gasoline-powered, internal combustion engines. The applicable classification subheading for both Bundled Pipe Assemblies (Part #s 13276455 & 13253292) will be 8708.99.8180, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Parts … of … motor vehicles … : Other parts … : Other: Other: Other: Other: Other: Other.” The rate of duty will be 2.5%. Products of Mexico classifiable under subheading 8708.99.8180, HTSUS, are currently entitled to duty-free treatment under the North American Free Trade Agreement (NAFTA) upon compliance with all applicable regulations. NAFTA, however, is subject to modification and periodic suspension which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse.
