Dear Ms. Dennison: In your letter dated March 17, 2010, you requested a tariff classification ruling. As requested, your sample will be returned. Style XPS17190 is a men’s shirt constructed from 100% polyester, closed mesh knit fabric that measures 18 stitches per linear centimeter counted in the horizontal direction and 20 stitches per linear centimeter counted in the vertical direction. The shirt has a rib knit spread collar; a partial front opening with two button closures; short sleeves with rib knit cuffs; a screen printed logo on the left sleeve; a rubberized appliqué on the rear panel; and a straight, hemmed bottom with side slits and a tail. The upper rear panel has a mesh knit lining and open armholes for ventilation. The applicable subheading for Style XPS17190 will be 6105.20.2010, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: men’s or boys’ shirts, knitted or crocheted: of man-made fibers: other: men’s. The duty rate is 32% ad valorem. Duty rates are provided for your convenience and are subject to change.
