Powers Lane Aurora, CO 80015 RE: The tariff classification of a Biker Paul Sr. Costume from China. Dear Mr. Williams: In your letter dated November 18, 2010, but received January 11, 2010, you requested a tariff classification ruling. You submitted a sample of a Biker Paul Sr. Costume, identified as style #CS10-0134, which is comprised of a black polyester knitted fabric muscle shirt that features on its chest a heat transfer of the logo from the television show “Orange County Choppers.” The muscle shirt has a double layer collar, a well-made neck, loose single straight stitched seams, a hook and loop tab closure, and loose visible overlock stitched and/or raw edges at the arms, closure and hem. The flimsy garment is marketed and sold as a costume for a person simulating Biker Paul Sr. from the television show “Orange County Choppers.” The applicable subheading for the Biker Paul Sr. Costume identified as style #CS10-0134 will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other."
