Dear Ms. Ekman: In your letter dated January 7, 2010, on behalf of Penn Safety, Buena Park, CA, you requested a tariff classification ruling. The instant sample, which was not identified as to style or quality number, consists of a woven scrim of polyethylene/polyester plastic strips which measure less than 5 mm in apparent width, and, as such, are considered to be of man-made textile for tariff purposes. This scrim has been laminated on one side with a melt blown nonwoven fabric (staple fiber) via a hot melt glue. You indicate that this material will be imported as roll goods and has application on the exterior of buildings before the siding is applied. The instant sample was informally weighed and was found to weigh approximately 78 grams per square meter. You suggest that classification is proper in tariff subheading 3921.19 which provides for … other plates, sheets, film, foil and strip, … of plastics. This, however, is not correct as the product is more specifically classifiable as a laminated nonwoven as described below. The applicable subheading for the material will be 5603.93.0090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for nonwovens, whether or not impregnated, coated, covered or laminated, other than filament (staple): weighing more than 70 g/ m², but not more than 150 g/ m².
