Dear Mr. Armbruster: In your letter dated December 17, 2009, you requested a tariff classification ruling. The merchandise under consideration consists of a decorative ceramic pitcher of porcelain, item number 124029704. The pitcher measures 9 inches in height. You state that the pitcher is intended as a decorative accent piece for the home. You also state that the pitcher is not safe for food and drink contact and will be labeled as such, and that it will be displayed and sold in the home décor section of your stores, not with kitchen or food ware products. You have submitted a photograph of the pitcher with your request. The applicable subheading for the decorative porcelain pitcher, item number 124029704, will be 6913.10.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Statuettes and other ornamental ceramic articles: Of porcelain or china: Other: Other.” The rate of duty will be Free.
