The subject merchandise consists of an orange flavored beverage, stated to contain the following ingredients: 75.11 percent water, 8.62 percent orange juice from concentrate, 9.20 percent corn syrup, 6.90 percent sugar, 0.15 percent citric acid and 0.15 percent orange flavor. The product will be imported for retail sale in a ready to drink 200 milliliter and 1 liter tetra pak. The applicable subheading for the “Reddy”, Orange Juice will be 2202.90.9090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for provides for Waters, including mineral waters and aerated waters, containing added sugar or other sweetening matter or flavored, and other nonalcoholic beverages, not including fruit or vegetable juices of heading 2009: Other: Other…Other. The rate of duty will be 0.2 cents per liter. Articles classifiable under subheading 2202.90.9090, HTSUS, which are products of Argentina, may be entitled to duty-free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse.
