Ruling Text

N074197 September 28, 2009 CLA-2-62:OT:RR:NC:TA:357 CATEGORY: Classification TARIFF NO.: 6202.93.5011 Ms. Melissa Fox Barthco International, Inc. 5101 S. Broad St. Philadelphia, PA 19112-1404 RE: The tariff classification of a women’s knit and woven jacket from China Dear Ms. Fox: In your letter dated August 27, 2009, on behalf of Revue, LLC, you requested a tariff classification ruling. The sample you submitted is being returned as you requested. The item in question, style 940218v, is a women’s outerwear garment made from knit and woven fabrics. The body panels are made from an outer layer fabric of 100% woven polyester and an inner fabric of low-twist 70% acrylic/30% wool woven. The fabrics are joined by needle punching which produces a box-like pattern of knit fibers on the outer surface. The sleeves are made from a rib-knit fabric, as are the waistband and the collar. The jacket has a full front opening with a zipper closure that extends to the top of the collar and slant pockets with zipper closures at the waist. The applicable subheading for the jacket will be 6202.93.5011, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other women’s or girls’ anoraks (including ski-jackets), windbreakers and similar articles, of man-made fibers. The rate of duty will be 27.7 percent ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
