The submitted sample labeled 803-20601 is a child’s thong sandal with an elasticized textile material heel strap and textile material toe thong. Textile material accounts for over 10 percent of the external surface area of the upper. The outer sole and upper are predominantly rubber/plastics. The applicable subheading for Item # 803-20601 will be 6402.99.4080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for footwear with outer soles and uppers of rubber or plastics: other: not having uppers of which over 90 percent of the external surface area (including accessories or reinforcements) is rubber or plastics: other: other, footwear with open toes or open heels. The rate of duty will be 37.5 percent ad valorem. The sample labeled 6151957A is a ladies thong sandal with plastic jewels sewn along the upper. The outer sole and upper are rubber/plastics. The applicable subheading for Item # 6151957A will be 6402.99.3165, HTSUS, which provides for footwear with outer soles and uppers of rubber or plastics: other: having uppers of which over 90 percent of the external surface area (including accessories or reinforcements) is rubber or plastics: other, for women, other.
