N071659 September 1, 2009 CLA-2-84:OT:RR:E:NC:N1:102 CATEGORY: Classification TARIFF NO.: 8412.90.9080 Mr. Gregory John Breault Gamesa Wind 400 Gamesa Drive Fairless Hills, PA 19030 RE: The tariff classification of slewing rings from France Dear Mr. Breault: In your letter dated August 11, 2009 you requested a tariff classification ruling. Descriptive literature was submitted. The items you plan to import are described as slewing rings or blade bearings. These slewing rings are made specifically for use in the hub assembly of a wind turbine system. They are situated between the wind turbine’s blades and the hub assembly. The function of the rings is to join the blades to the hub. In addition, they allow the blades to rotate slowly in order to more effectively capture the wind’s speed. The slewing rings are comprised of a double row ball bearing, an outer ring that is attached to the hub, an inner ring that is attached to the blade and a blade locking device that is designed to lock the blades in place once they are set by the turbine’s computer system. After importation, the blade locking device along with a pitch control system cylinder that controls the speed of a wind turbine by varying the pitch of the blades in accordance with the turbine’s computer system are attached to the slewing rings during hub assembly. The applicable subheading for the slewing rings will be 8412.90.9080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for parts of other engines and motors. The rate of duty is free. Duty rates are provided for your convenience and are subject to change.
