Speer Xcel International, Inc. 66-590 Kamehameha Highway Haleiwa, HI 96712 RE: The tariff classification of components for a flotation device, from China Dear Ms. Speer: In your letter dated July 24, 2009, you requested a tariff classification ruling. The submitted samples are components of a personal flotation device. They are cut shapes constructed of polyolefin foam laminated on both sides with knit textile fabric; this construction is considered a textile fabric for tariff purposes. They are considered made up according to the terms of Note 7 to Section XI, Harmonized Tariff Schedule of the United States (HTSUS). In a telephone conversation with this office, you stated that the pieces are imported in bulk shipments, not as unassembled vests. The applicable subheading for the cut textile shapes will be 6307.90.9889, HTSUS, which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. The sample will be returned as requested. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
