Tibbs Avenue: Speed Code S31D Indianapolis, IN 46241 RE: The tariff classification of seals from Finland, Sweden or Norway Dear Ms. Morrow: In your letter dated July 24, 2009, you requested a tariff classification ruling. The products are identified as x-rings and v-rings. The x-rings are round seals which roughly resemble the letter “x” in a cross-sectional slice. The v-rings are round seals with a sealing lip that resembles the letter “v” in cross-section. The samples provided with your letter are made of nitrile rubber. Similar rings will also be made of fluorocarbon elastomer. The applicable subheading for the x-ring seals and v-ring seals made of nitrile rubber will be 4016.93.5050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of vulcanized rubber other than hard rubber: other: gaskets, washers and other seals: other…other. The rate of duty will be 2.5 percent ad valorem. Your inquiry does not provide enough information for us to give a classification ruling on the x-ring seals and v-ring seals made of fluorocarbon elastomer. Classification of such articles is dependent on the sole or principal use of the seals. Your request for a classification ruling on these seals should include complete details about exactly where and how they are used. If the seals have more than one application, provide details about where and how such seals are principally used.
