N069506 August 11, 2009 CLA-2-73:OT:RR:NC:N1:113 CATEGORY: Classification TARIFF NO.: 7326.20.0070 Ms. Sylvia Balev Marc Jacobs, Inc. 72 Spring Street, 9th floor New York, NY 10012 RE: The tariff classification of a novelty key ring from China Dear Ms. Balev: In your letter dated July 21, 2009, you requested a tariff classification ruling. A sample of the item was submitted for our review which will be returned to you as requested. The merchandise is identified as the Miss Marc Keychain (item number M593860). It consists of an iron split wire ring attached by an iron wire “o” ring and a copper swivel connector to a stuffed fabric pillow shape. The information you provided indicates that the iron predominates by weight over the copper. The pillow shape measures approximately 3.5 inches in length, 2 inches in width and 1 inch in thickness. The surface of the pillow depicts a big eyed character dressed in a shroud like garment and wearing a sign around its neck that reads “Don’t Fret My Pet”. The applicable subheading for the Miss Marc Keychain will be 7326.20.0070, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of iron or steel, articles of iron or steel wire, other. The rate of duty will be 3.9 percent ad valorem. In your letter, you also asked whether any type of fabric or filler content tag is required on your product. Please note that separate Federal Trade Commission marking requirements exist regarding country of origin, fiber content, and other information that must appear on many textile items.
