Pulis Genesis Sales Agency, LLC 5840 Red Bug Lake Road PMB #1 Winter Springs, FL 32708 RE: The tariff classification of masks from China Dear Mr. Pulis: In your letter dated July 16, 2009, you requested a tariff classification ruling. The submitted samples are two disposable facemasks. They are constructed of non-woven polypropylene microfiber textile fabric. One mask is molded and the other is sewn. They will be used both in the industrial and medical markets to help reduce or prevent the inhalation of air contaminated with various particles. The subject masks are single use with no replaceable parts and are intended to be disposed of at the end of the work shift or when damaged or dirty. The mask is placed over the nose and mouth area and affixed to the head by an elastic fabric inserted through the mask that can be placed around the individual’s ears. The applicable subheading for the masks will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. The sample will be returned as requested. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
