N067857 August 5, 2009 CLA-2-44:OT:RR:NC:2:230 CATEGORY: Classification TARIFF NO.: 4421.90.9760 Ms. Bernadette Purcell QVC, Inc. 1200 Wilson Drive West Chester, PA 19380 RE: The tariff classification of “Glitter Twig Branches” from China Dear Ms. Purcell: In your letter dated June 22, 2009, you requested a tariff classification ruling. You submitted a sample of a group of three (connected) “Glitter Twig Branches” (Item # H16689). The “Glitter Twig Branches”, which are made of willow branches, are 36” tall and coated with colored glitter. You stated in a phone conversation with this office that the twigs are interlaced with a string of 30 white, frosted LED lights that will operate with a battery box containing three “C” batteries (not included). (The sample submitted did not include the battery operated box with timer.) The instructions you provided with the sample indicate that the battery box contains an on/off switch and an automatic timer that will allow the lights to stay lit for 6 hours and turn off for 18 hours at a pre-set time of day. The “Glitter Twig Branches” are available in white, red and gold colors. The cluster of twigs interlaced with LED lights is a decorative article for indoor use only. The applicable subheading for the “Glitter Twig Branches” will be 4421.90.9760, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of wood. The rate of duty will be 3.3 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
