Alcantara Leon Leather Co., Inc. 140 Lakeside Drive East Port Orange, FL 32128 RE: The tariff classification of polyethylene retail carrier bags from China Dear Mr. Alcantara: In your letter dated May 8, 2009, you requested a tariff classification ruling. The sample submitted with your request is a polyethylene retail carrier bag. The t-shirt style handled bag measures approximately 23 inches in length and 12 inches in width, with a 7 inch side gusset and no bottom gusset. The bag is printed with the name and address of a retail supplier of leather products. The applicable subheading for the bags will be 3923.21.0085, Harmonized Tariff Schedule of the United States (HTSUS), which provides for articles for the conveyance or packing of goods, of plastics…sacks and bags (including cones): of polymers of ethylene…polyethylene retail carrier bags (PRCBs) with handles (including drawstrings), with no length or width shorter than 6 inches or longer than 40 inches. The general rate of duty will be 3 percent ad valorem. Polyethylene retail carrier bags from China may be subject to antidumping (AD) duties.
