Dear Ms. Root: In your letter dated April 15, 2009, on behalf of Philips & Lite-On Digital Solution USA, you requested a tariff classification ruling. The merchandise under consideration is a scanning digital photo frame, denoted as the skyla Memoir FS80. This 8-inch LCD digital photo screen incorporates video and sound recording and reproducing apparatus, as well as an integrated scanner to convert printed photographs into digital files, which are recorded on the frame's 1GB internal memory. This digital photo display contains a five-in-one memory card reader (CF/SD/MMC/MS/xD) and supports the following file formats: JPEG, MPEG 1, MPEG 4, Motion JPEG, and MP3. In addition, this device, which features a built-in alarm clock and calendar, displays the following: instant playback in thumbnail view, slideshow with transition effects, slideshow with MP3 music, and auto rotatation of the scanned images, along with existing digital files. Furthermore, recorded images can be transferred to an external PC or a USB drive. The applicable subheading for the scanning digital photo frame will be 8528.59.1500, which provides for Monitors and projectors, not incorporating television reception apparatus; reception apparatus for television, whether or not incorporating radio-broadcast receivers or sound or video recording or reproducing apparatus: Other monitors: Other: Color: With a flat panel screen: Incorporating video recording or reproducing apparatus: With a video display diagonal not exceeding 34.29 cm.
