Dear Mr. Nagel and Ms. Carothers: In your letter dated March 13, 2009, you requested a tariff classification ruling. As requested, your sample will be returned. Style PO12 is a pair of men’s pants constructed from 100% cotton, heavy weight waffle knit fabric. The pants have a rib knit tunnel elastic waistband with an outside drawstring, side seam pockets, an embroidered logo on the left hip, and hemmed legs. In your correspondence, you refer to Style PO12 as sleepwear and provide a mock-up of a hangtag stating “Sleepwear.” However, garments of this style are considered multi-use lounge wear garments that may be worn in a variety of informal situations in and around the home. As such, the garments are not classified as sleepwear, which is limited to garments that are designed for wear only to bed for sleeping. The applicable subheading for Style PO12 will be 6103.42.1020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for men’s and boys’… trousers, …breeches and shorts (other than swimwear), knitted or crocheted: of cotton: trousers and breeches … men’s. The rate of duty is 16.1% ad valorem. Duty rates are provided for your convenience and are subject to change.
