The samples which you submitted are being returned as requested. Style P-005180NC is a tote bag constructed with an outer surface of polyvinyl chloride (PVC) plastic sheeting material. The tote bag is designed to provide storage, organization, protection and portability to clothing and other personal effects during travel. It has a main textile-lined compartment with a zippered pocket and two open pockets on the sidewalls. The bag has an open top with a magnetic closure and a single shoulder strap. It measures approximately 14.5” (W) x 12.5” (H) x 2.5” (D). Style P-0050403NC is a tote bag semi-triangular in shape, and constructed with an outer surface of PVC plastic sheeting material. The tote bag is designed to provide storage, organization, protection and portability to clothing and other personal effects during travel. It has a main textile-lined compartment with a zippered pocket and two open pockets on the sidewalls. The bag has an open top with a magnetic closure and a single shoulder strap. It measures approximately 14” (W) x 11” (H) x 5” (D). In your letter, for styles P-005180NC and P-0050403NC, you suggest subheading 4202.22.1500, Harmonized Tariff Schedule of the United States (HTSUS) which provides for, in part, for handbags, whether or not with shoulder strap, including those without handle, with outer surface of sheeting of plastic. Classification under the HTSUS is made in accordance with the General Rules of Interpretation (GRI). Pursuant to GRI 1, goods shall be determined according to the terms of the headings of the tariff schedule and any relative Section or Chapter Notes under the heading that most specifically describes them. Both styles are designed and sized to contain the larger personal effects that would normally be carried in a travel bag such as clothing, books, sundry articles or food. Therefore, both are more specifically classified under subheading 4202.92.4500, HTSUS. Style P-0051301NC is a tote bag constructed with an outer surface of PVC plastic sheeting material. The bag is designed to provide storage, organization, protection and portability to clothing and other personal effects during travel. The bag features a textile-lined interior compartment with a zippered pocket and two open pockets on the sidewalls. The bag has a flap that secures with a magnetic closure and a single shoulder strap. The front exterior has two open pockets. It measures approximately 15” (W) x 10” (H) x 6” (D). The applicable subheading for styles P-005180NC, P-0050403NC and P-0051301NC will be 4202.92.4500, HTSUS, which provides for travel, sport, and similar bags, with outer surface of sheeting of plastic, other. The rate of duty will be 20% ad valorem. Duty rates are provided for your convenience and are subject to change.
