The tariff classification of a fabric edging from Belgium

Box 20160 Charleston, SC 29413-0160 RE: The tariff classification of a fabric edging from Belgium Dear Ms. McEachem: In your letter dated November 20, 2008, you requested a tariff classification ruling on behalf of your client, Tri Vantage, of Statesville, North Carolina. The submitted sample is identified as a kador. It is a PVC-coated textile fabric, 1¼” in width, that is welded on to a flexible, round extruded PVC core that is 1/4" in diameter. You state that it is used to make various maritime coverings, tents, etc. It appears to be an edging that is inserted in to a seam, with the PVC core protecting the edge. The applicable subheading for the Kador will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem. In your letter you suggested that the item be classified under subheading 5911.90.0090, HTSUS, which provides for textile products and articles for technical uses. It would not be classified under that subheading as it does not rise to the level of technical use as defined in Note 7 to Chapter 59. That is, it does not present any unique characteristics that identify it for use with various types of machinery, apparatus, equipment, instruments, or tools that are generally used to process or manufacture other materials.
