N045596 December 8, 2008 CLA-2-63:OT:RR:NC:N3:351 CATEGORY: Classification TARIFF NO.: 6307.90.9889 Una Gauthier CVS Onsite Import Client Liaison Barthco International, Division of OHL One CVS Drive Woonsocket, RI 02895 RE: The tariff classification of a decorative lighted bunny from China Dear Ms. Gauthier: In your letter dated November 25, 2008, you requested a tariff classification ruling on behalf of your client, CVS Pharmacy, of Woonsocket, Rhode Island. The submitted sample is a bunny decoration (Item Number 476155). The head, arms, and legs are made of textile fabric stuffed with textile fibers; the ears are textile fabric. The body is a plastic globe with a battery-powered bulb that illuminates the article but does not provide light; the light merely enhances the decorative nature of the article. The item is approximately 4” tall. There is an on/off switch attached to the bottom of the bunny. It is powered by three 1.5 volt batteries which are included. The applicable subheading for the decorative lighted bunny will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
