Dear Mr. Wood: In your letter dated November 11, 2008 you requested a classification ruling. As requested, your sample is being returned to you. The submitted sample, style FDS-3232337, is a woman’s “All American Comfort” label cut & sewn cardigan that is constructed from 100% polyester finely knit fabric that is napped on both the inside and outside surfaces. The outer surface of the garment fabric measures more than nine stitches per two centimeters in the direction that the stitches were formed. The garment extends to below the waist. The cardigan features a stand-up collar, a full front zippered opening, long sleeves with capped endings, two side inset pockets, and a loose fitting capped garment bottom. You asserted classification as a jacket under 6102.30.2010, HTSUS. However, the loose fitting bottom of the garment would not provide sufficient protection against the elements to warrant classification as such. The garment is properly classified as a cardigan of 6110, HTSUS. The applicable subheading for the cardigan will be 6110.30.3059, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: women’s or girls’: other. The duty rate will be 32%. Duty rates are provided for your convenience and are subject to change. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries.
