N040235 October 15, 2008 CLA-2-73:OT:RR:NC:N1:113 CATEGORY: Classification TARIFF NO.: 7326.90.8588 Ms. Sylvia Perreira EGL Eagle Global Logistics 2190 Hanson Way Woodland, CA 95776 RE: The tariff classification of a flanged stud made in Taiwan and China Dear Ms. Perreira: In your letter dated September 16, 2008, on behalf of Amsak Corporation, you requested a tariff classification ruling. Copies of photographs and specifications for the flanged stud were submitted with your ruling request. The item is described in your letter as a ¾-10x4 inch flanged stud made of zinc plated steel. The stud measures 4 inches in length with a shank diameter of ¾ inch and 10 threads per inch. The item has a continuously threaded straight shank with a round flat head. You indicated that the flanged stud is used in an Access Floor System. You stated that the subject merchandise is made in Taiwan and future shipments will also be made in China. You proposed classification for the flanged stud under heading 7318, Harmonized Tariff Schedule of the United States (HTSUS). The intent of the flanged stud is to provide a mechanism to adjust the height of a pedestal assembly. The item is fully threaded and the height is adjusted with the aid of an adjusting nut to create a level floor height. Heading 7318, HTSUS, does not include “threaded mechanisms, sometimes called screws, used to transmit motion.” The applicable heading for the flanged stud will be 7326, HTSUS, which provides for other articles of iron or steel. The applicable subheading for the flanged stud will be 7326.90.8588, HTSUS, which provides for other articles of iron or steel, other, other, other, other, other. The rate of duty will be 2.9 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
