Santos Supreme International, LLC 3000 NW 107th Avenue Miami, FL 33172 RE: The tariff classification of a woman’s knit top from China Dear Ms. Santos: In your letter dated September 22, 2008 you requested a classification ruling. The submitted sample, Style # 98RS4014, is a woman’s knit top constructed from 72% cotton and 28% silk knit fabric. The top features ¾ length sleeves, a full front opening with a tie closure at the bust and a self start bottom. The garment extends from the shoulders to just above the waist. We are returning your sample as you requested. The applicable subheading will be 6114.20.0010 Harmonized Tariff Schedule of the United States (HTSUS), which provides for other garments, knitted or crocheted of cotton, tops, women’s or girls’. The rate of duty will be 10.8% ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. The top falls within category designation 339. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries.
