N038694 October 3, 2008 CLA-2-63:OT:RR:NC:N3:351 CATEGORY: Classification TARIFF NO.: 6307.90.9889 Joel Baggett Hampton Bay 448 Lane Drive Florence, AL 35630 RE: The tariff classification of an assembled fabric from China Dear Mr. Baggett: In your undated letter received in our office on Sept. 18, 2008, you requested a tariff classification ruling. The samples which you submitted are being returned. You submitted two samples. Both are the fabric that will become a dog food bag and will be imported in 500-ft. rolls. The fabric is woven of polypropylene strips. The strips meet the dimensional requirements of man-made fiber textile strips contained in Section XI, Legal Note 1(g) of the Harmonized Tariff Schedule of the United States (HTSUS). The first sample is in the form of tubular fabric, created by gluing the sides together. This is considered a made up article for tariff purposes. Note 7(e) to Section XI, HTSUS, noted. The applicable subheading for the tubular fabric will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. Your inquiry does not provide enough information for us to give a classification ruling on the second sample, which is what you refer to as open width form. Your request for a classification ruling should include the following information: Composition of coating material, i.e., PVC, polyurethane, polypropylene, etc. Weight of the coated fabric. Weight of the uncoated fabric. Weight of the coating material in the finished imported fabric. Express all weights in grams per square meter (g/m2). When this information is available, you may wish to consider resubmission of your request. We are returning the samples. If you decide to resubmit your request, please include all of the material that we have returned to you. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
