Benway Taco, Inc. 1160 Cranston Street Cranston, Rhode Island 02920 RE: The tariff classification of a steel clip motor support/bracket for liquid pumps from China; Modification of New York ruling N019216 Dear Ms. Benway: In your letter dated September 10, 2008 you requested that we consider additional information and review our finding in New York ruling N0192216, which was issued to you on November 8, 2007. This ruling is being issued to modify our previous ruling. In your request you indicate that the steel clip, part number 108-012, considered in ruling N019216, which was described therein as a “clip used to hold a pump motor”, is actually specifically designed as a part of a liquid pump assembly. The additional information you have submitted indicates that the steel clip permits the attachment of the prime mover of the pump and serves to complete the pump assembly. As such we find that the steel clip is provided for as a part of the pump in heading 8413, Harmonized Tariff Schedule of the United States (HTSUS). We also note that the same steel clip was properly classified as a part of a liquid pump in New York ruling N022481. The applicable subheading for the steel clip will be 8413.91.9080, HTSUS, which provides for other parts of liquid pumps. The rate of duty is free. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
