Broad Street Philadelphia, PA 19112 RE: The tariff classification of a woman’s knit top from Hong Kong. Dear Ms. Root: In your letter dated September 5, 2008, on behalf of your client Sugartown Worldwide, you requested a tariff classification ruling. The submitted sample, Style #70783, is a woman’s top constructed from 100% cotton knit fabric. The garment features long sleeves with rib knit cuffs, a full front opening, and a self-start rib knit bottom. The garment does not reach the waist in front, but does provide sufficient coverage of the bust. Your sample is being returned as requested. The applicable subheading for the top, Style 70783, will be 6114.20.0010 Harmonized Tariff Schedule of the United States (HTSUS), which provides for other garments, knitted or crocheted, of cotton, Tops: Women’s or girls’. The rate of duty will be 10.8% ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. The top, Style 70783 falls within textile category 339. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
