Dear Mr. Ponthieux: In your letter dated August 28, 2008, you requested a classification ruling. The submitted sample is identified as pattern “Fairlane”. It is a jacquard woven fabric composed of 65.7% staple acrylic and 34.3% filament polyester. The woven fabric is constructed with yarns of different colors. It contains 92 single yarns per inch in the warp and 35 single yarns per inch in the filling. This merchandise weighs 234 g/m2 and will be imported in 137.16 centimeter widths. Your correspondence indicates that this fabric will be used as upholstery. The applicable subheading for this fabric will be 5516.23.0090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for woven fabrics of artificial staple fibers, containing less than 85 percent by weight of artificial staple fibers, mixed mainly or solely with man-made filaments, of yarns of different colors, other. The duty rate will be 8.5%. Duty rates are provided for your convenience and are subject to change.
