Dear Ms. Emiliani: In your letter dated August 28, 2008, you requested a tariff classification ruling. As requested, your samples will be returned. Style Fourtette (Style # 00D3KA) is a men’s jacket constructed from 96% cotton, 4% elastane, French terry knit fabric. The jacket has a lined, self-fabric hood; a full front opening with a zippered closure; long sleeves with rib knit cuffs; an ornament on the left chest; a large screen printed design on the back panel; side seam pockets at the waist; and a rib knit bottom. Style Fiery (Style # 00D3JI) is a men’s jacket constructed from 100% cotton, French terry knit fabric. The jacket has a self-fabric stand-up collar; a full front opening with a zippered closure; long sleeves with rib knit cuffs; screen print designs on the center chest, the back panel and the sleeves; side seam pockets below the waist; a small label in the lower left side seam; and a rib knit bottom. The applicable subheading for Styles Fourtette (Style # 00D3KA) and Fiery (Style # 00D3JI) will be 6101.20.0010, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: men’s or boys’ overcoats, carcoats, capes, cloaks, anoraks (including ski-jackets), windbreakers, and similar articles, knitted or crocheted: other than those of heading 6103: of cotton: men’s. The rate of duty is 15.9% valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. Styles Fourtette (Style # 00D3KA) and Fiery (Style # 00D3JI) fall within textile category designation 334. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
