Dear Ms. Polston: In your letter dated August 14, 2008, you requested a classification ruling. The submitted sample, Style #5A1086, is a woman one-piece romper. The sleeveless romper is constructed from 92% cotton and 8% elastane knit fabric and features elasticized adjustable spaghetti straps, a keyhole type opening with a tie closure at the front neckline, elastic all around the lower portion of the garment, and lace finishing the leg openings. We are returning your sample as you requested. The applicable subheading for the romper, style 5A1086, will be 6114.20.0040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Other garments, knitted or crocheted: Of cotton: Sunsuits, washsuits, one-piece playsuits and similar apparel: Women’s. The duty rate will be 10.8% ad valorem.     Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. The romper, Style 5A1086, falls within textile category 237. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
