N036381 September 16, 2008 CLA-2-83:OT:RR:NC:N1:121 CATEGORY: Classification TARIFF NO.: 8306.29.0000 Ms. Traci Manuel Virgo III Ltd. 766 Knox Court Yardley, PA 19067 RE: The tariff classification of a decorative pick from China Dear Ms. Manuel: In your letter dated August 13, 2007, on behalf of Godiva Chocolatier, you requested a tariff classification ruling. The sample which you submitted is being retained by this office. The merchandise under consideration is described as “Godiva’s 2009 Mother’s Day Pick.” It measures 2 inches in diameter by ¾ inch deep and is composed of copper wire, felt fabric and plastic beads with a metal pin for attaching. The pick is used by Godiva to decorate chocolate boxes that are sold at retail during the Mother’s day season. The applicable subheading for the decorative pick will be 8306.29.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for bells, gongs and the like, nonelectric, of base metal…statuettes and other ornaments, and parts thereof, other. The rate of duty will be free. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
