Dear Mr. Crago: In your letter dated August 21, 2008, you requested a tariff classification ruling. You have submitted a photograph of an article identified as item number A079IA00578, Halloween Pumpkin Table Decoration. The article consists of an orange pumpkin made of 100% porcelain that measures approximately 5-1/2” in height and 6-3/4” in diameter and is covered with a hand-painted spider’s web. A black widow-shaped spider is permanently attached to the pumpkin and simulates that the spider is crawling down the web. The Halloween Pumpkin Table Decoration is a purely decorative article that is intended to decorate a table top and help create a scary environment for the Halloween holiday. The applicable subheading for item number A079IA00578, Halloween Pumpkin Table Decoration, will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other." The rate of duty will be Free. Duty rates are provided for your convenience and are subject to change.
