N036039 September 9, 2008 CLA-2-57:OT:RR:NC:N3:349 CATEGORY: Classification TARIFF NO.: 5703.90.0000 Ruby Wood Sevcik Pier 1 Imports Post Office Box 961020 Forth Worth, Texas 76161-0020 RE: The tariff classification of a tufted rug from India Dear Ms. Sevcik: In your letter dated August 18, 2008 you requested a classification ruling. The submitted sample, identified as SKU 2333346, is a section of a rug. The rug is made from 100 percent cotton yarns that are hand tufted into a woven cotton backing fabric. The back of the rug is coated with latex and a secondary backing is applied. The rug will measure 32 x 56 inches and all of the edges will be finished. The applicable subheading for the rug will be 5703.90.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for carpets and other textile floor coverings, tufted, whether or not made up: of other textile materials. The duty rate will be 3.8 percent ad valorem. Duty rates are provided for your convenience and are subject to change. The rug falls within a subheading that is not assigned a textile category designation.. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
