Broad Street Philadelphia, PA 19112 RE: The tariff classification of a woman’s jacket from China Dear Ms. Root: In your letter dated August 13, 2008, on behalf of Revue LLC, you requested a classification ruling. The sample submitted, style number 910245, is a woman’s hip-length jacket with a shell composed of a woven 85% cotton/15% nylon fabric that is coated with a breathable polyurethane membrane. The jacket is fitted at the waist and has a full front opening secured by a zipper closure, a stand-up collar, long hemmed sleeves and two front pockets with zipper closures at the waist. The jacket also has two self-fabric bands on the lower portion of each side held together by a metal D-ring in the center and a straight cut bottom hem. Although you indicated in your letter that the jacket has a breathable polyurethane membrane, there is no evidence of a membrane or other form of coating on the garment. The applicable subheading for the jacket will be 6202.92.2061, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other women’s anoraks, windbreakers and similar articles: of cotton: other: other: other. The duty rate will be 8.9 percent ad valorem. Duty rates are provided for your convenience and are subject to change. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
