Dear Mr. Nagel: In your letter dated August 7, 2008 you requested a classification ruling. As requested, your sample is being returned to you. Style number 5695 is a woman’s “Champion” label cut and sewn pullover that is constructed from 88% polyester and 12% spandex knitted fabric that has been brushed on the inner surface. The outer surface of the garment measures more than nine stitches per two centimeters in the direction that the stitches were formed. The garment features a stand-up collar with a partial zippered opening, long sleeves with capped endings, a kangaroo pouch pocket below the waist, contrast color inserts extending down the side panels of the garment, the “Champion” logo printed on the upper left front panel, and a straight garment bottom. The applicable subheading for style 5695 will be 6110.30.3059, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: Other: other: other: other: women’s or girls’. The duty rate will be 32%. Duty rates are provided for your convenience and are subject to change. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
