That request was rejected by the National Commodity Specialist Division with a request for a sample on July 22. We received your submitted sample on August 5 and now have sufficient information to issue a ruling. The item in question is identified as a spa cover that is intended to cover and protect spas, hot tubs, and jacuzzis from undesirable debris. It is constructed of woven polyester textile fabric. It measures 92” x 92” x 32” and features a ball cinch at the bottom to attach the cover to the spa. The applicable subheading for the spa cover will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
