One Claiborne Avenue HQ2 7th Floor North Bergen, NJ 07047 RE: The tariff classification of a men’s knit pullover garment from Jordan. Dear Ms. Collins: In your letter dated July 30, 2008, you requested a tariff classification ruling. As requested, your sample will be returned. The submitted sample, DKMY Men’s Apparel Style KKRU1574 / KKRU1575, is a men’s cut and sewn pullover garment constructed from 64% polyester, 36% acrylic, drop needle sherpa knit pile fabric that measures 11 stitches per two centimeters counted in the horizontal direction. Style KKRU1574 / KKRU1575 has a mock turtleneck collar, a partial front opening with a zippered closure, long sleeves, and a straight bottom with side slits. The collar, the sleeves, and the bottom are finished with overlock stitching. The applicable subheading for Style KKRU1574 / KKRU1575 will be 6110.30.3053, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: other: men’s or boy’s: other. The rate of duty is 32% ad valorem. Style KKRU1574 / KKRU1575 falls within textile category designation 638. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries.
