Dear Ramsey: In your letter dated July 17, 2008, you requested a classification ruling. The samples which you submitted are being returned as requested. Styles SKU 29980 Black and SKU 29982 Ivory hood scarf is made of knit 100% acrylic fabric measuring approximately 55 ½ inches in length. The item wraps around your neck and shoulders and the hood portion covers the head. Styles SKU 50082 Powder Pink and SKU 50080 Navy slipper that you state is for indoor use is made of knit 100% acrylic fabric knit to shape upper, with separately sewn on textile material outer sole which will contact the ground when in use. This indoor use slipper has an upper that covers the wearer’s ankle and is not designed to be worn inside a shoe. The applicable subheading for the hooded scarf, Styles SKU 29980 and 29982 will be 6505.90.6090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Hats and other headgear, knitted or crocheted: Other: Of man-made fibers: Knitted or crocheted or made up from knitted or crocheted fabric: Not in part of braid, Other, Other, Other." The rate of duty will be 20 cents per kg + 7 percent ad valorem. The textile category designation is 659.  The applicable subheading for the slipper, Styles SKU 50082 and SKU 50080 will be 6405.20.9015, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other footwear: with uppers of textile materials: other…house slippers. The rate of duty will be 12.5 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
