Wolfer Allports, Inc. 5933 NE Win Sivers Drive, Suite 301 Portland, OR 97220 RE: The tariff classification of an ornament storage bag from China Dear Mr. Wolfer: In your letter dated July 1, 2008, you requested a tariff classification ruling on behalf of your client, Richards Homeware, Inc. The submitted sample is an ornament storage bag. It is constructed of 100% polypropylene non-woven textile fabric over cardboard stiffener. The item measures approximately 4” x 18” in width and 30” in length. It is collapsible and features a woven textile fabric carrying handle on its top. It is for home storage of Christmas ornaments. The applicable subheading for the ornament storage bag will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem. In your letter you suggested classification under subheading 4819.20.0040, HTSUS, which provides for folding cartons, boxes, and cases, of non-corrugated paper or paperboard, other than sanitary food and beverage containers. However, the item is more than paper. It is covered with non-woven textile fabric. It is considered to be a textile product. General Rule of Interpretation 3(b), HTSUS, noted.
