Kim President Kentra International Services Corp. 145-34, 157th Street, 1st Floor Jamaica, NY 11434 RE: The tariff classification of an electric staple gun from Taiwan. Dear Mr. Kim: In your letter dated July 16, 2008, on behalf of Arrow Fastener Co., Inc., you requested a tariff classification ruling. You refer to model number EFTF50PBN as a craftsman electric staple gun. The staple gun shoots five sizes of T50 staples and drives 5/8 brad nails. It is hand held and operated by squeezing a trigger. It contains electronic circuitry and has a heavy duty ten foot cord attached. In a telephone conversation with National Import Specialist Patricia O’Donnell on August 7, 2008, you confirmed that the staple gun features a self-contained electric motor. The applicable subheading for the electric staple gun, model number EFTF50PBN will be 8467.29.0090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Tools for working in the hand, pneumatic, hydraulic or with self-contained electric or non electric motor, and parts thereof: With self-contained electric motor: Other: Other. The rate of duty will be free. Duty rates are provided for your convenience and are subject to change.
