Dear Mr. Ashear: This replaces Ruling Number N025712, dated May 2, 2008, which contained a typographical error; Style FGB28S304 should have read Style FGB38S304. A complete corrected ruling follows. Style FGB38S301 is a toque-style hat made of knit acrylic fabric and Style FGB38S304 is a hooded face mask made of knit acrylic fabric. The hooded face mask extends to the neck and has openings for the eyes and nose. The applicable subheading for Styles FGB38S301 and FGB38S304 will be 6505.90.6090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric...Other: Of man-made fibers: knitted or crocheted or made up from knitted or crocheted fabric: not in part of braid, Other: Other: Other." The duty rate will be 20 cents per kilogram plus 7% ad valorem. The textile category designation is 659. Duty rates are provided for your convenience and are subject to change.
