Dear Ms. Hu: In your letter dated July 2, 2008, you requested a classification ruling. The samples will be returned to you. Style 9766 is a driving cap made of woven 100% wool fabric. The cap is designed with a snap on the peak. Style 9779 is a bomber-style hat made of a knit pile 100% polyester fabric. The hat has earflaps and a textile chin strap. Style 9324 is a baseball-style cap made of woven 80% viscose/20% wool fabric, attached to the hat is a knit band used as earflaps. Style 9716 is a dress hat made of woven 30% wool/70% polyester fabric (black), or woven 10% wool/90% polyester fabric (plaid). Style 9775 is a bomber style hat made of woven 100% polyester fabric with pile trim. The hat has a chin strap with a hook and loop closure.  The applicable subheading for Style 9766 will be 6505.90.4090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric. . . .Other: Of wool: Other, Other: Other." The duty rate will be 31 cents per kilogram plus 7.9% ad valorem. The textile category designation is 459.   The applicable subheading for Style 9779 will be 6505.90.6090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric...Other: Of man-made fibers: knitted or crocheted or made up from knitted or crocheted fabric: not in part of braid, Other: Other: Other." The duty rate will be 20 cents per kilogram plus 7% ad valorem. The textile category designation is 659.  The applicable subheading for Styles 9324, 9716 and 9775 will be 6505.90.8090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric…Other: Of man-made fibers: Other: Not in part of braid, Other: Other: Other." The rate of duty will be 18.7 cents /kg + 6.8% ad valorem. The textile category designation is 659. Duty rates are provided for your convenience and are subject to change.
