N032690 July 9, 2008 CLA-2-63:OT:RR:NC:N3:351 CATEGORY: Classification TARIFF NO.: 6307.90.9889 Jane Jewett Talus Corporation 470 Riverside Street Portland, ME 04103 RE: The tariff classification of a chair caddy from China Dear Ms. Jewett: In your letter dated June 27, 2008, you requested a tariff classification ruling. The submitted sample is identified as a chair caddy. The item is constructed of woven cotton and nylon textile fabrics. It is an open pocket that measures approximately 7”H x 5½”W x 4½”D and, as your product literature indicates, can be used to store snacks, magazines, and remote controls. Four side pockets surround it and they are intended to hold eyeglasses, telephones, and remote controls. Two fabric straps extend from the back of the caddy and attach to a small “pillow” that is filled with pea gravel. Your literature shows how the “pillow” and straps can be used to hang the caddy over an armchair, wheelchair, or walker. The applicable subheading for the chair caddy will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem. Duty rates are provided for your convenience and are subject to change.
