Dear Ms. Root: In your letter dated June 24, 2008, on behalf of Revue LLC, 512 7th Avenue, New York, NY 10018, you requested a classification ruling. You submitted four samples that are being returned as requested. Style 849245S is a woman’s cardigan that is constructed from 100% wool brushed knit fabric (the body) and 100% wool 2 x 2 rib knit fabric (the collar and sleeves). The outer surface of the garment body fabric measures more than 9 stitches per 2 centimeters in the direction that the stitches were formed. The garment features a modified shawl ribbed collar, long ribbed sleeves, a full front opening with a 2 button closure, and a straight bottom. Style 849246 is a woman’s cardigan that is constructed from 100% wool brushed knit fabric (the body) and 100% wool rib knit fabric (the collar and sleeves). The outer surface of the garment measures more than 9 stitches per 2 centimeters in the direction that the stitches were formed. The garment features a notched lapel ribbed collar forming a V-neckline, long ribbed sleeves, a full front opening with 3 button closures, 2 front patch pockets at the waist, and a hemmed bottom. Style 849251 is a woman’s cardigan that is constructed from 100% wool brushed knit fabric (the body) and 100% wool 1 x 1 rib knit fabric (the collar and sleeves). The outer surface of the garment body fabric measures more than 9 stitches per 2 centimeters in the direction that the stitches were formed. The garment features a ribbed mock collar, long ribbed sleeves, a full front opening with 3 button closures, and a hemmed bottom. Style 849212 is a woman’s jacket that is constructed from 100% wool brushed knit fabric and features a convertible turtleneck collar with three large loop button closures, long sleeves with close fitting ribbed cuffs, a full front opening with a zipper closure, a storm flap with 2 snap closures, 2 front vertical flap pockets with non-functional buttons at the waist, and a close fitting ribbed bottom. The applicable subheading for styles 849245S, 849246, and 849251 will be 6110.11.0080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters…and similar articles, knitted: of wool or fine animal hair: of wool: other: women’s. The duty rate will be 16% ad valorem. The applicable HTSUS subheading for style 849212 will be 6102.10.0000, which provides for women’s overcoats, carcoats…and similar articles, knitted, other than those of heading 6104: of wool or fine animal hair. The duty rate will be 55.9 cents/kg + 16.4% ad valorem. Duty rates are provided for your convenience and are subject to change.
