Dear Ms. Williams: In your letter dated June 6, 2008, you requested a classification ruling. As requested, the sample will be returned. The submitted sample, Style # AF8AC92419K, is a Ladies’ Cloche Hat constructed of a knit 77% acrylic/23% polyester fabric crown and wool felt fabric brim. The hat features a fabric hatband with a bow, woven fabric sweatband, and has an approximately 2½-inch brim. The knit fabric component imparts the essential character of the hat. The applicable subheading for the Style # AF8AC92419K Ladies’ Cloche Hat will be 6505.90.6090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric...Other: Other: Of man-made fibers: knitted or crocheted or made up from knitted or crocheted fabric: not in part of braid, Other: Other: Other." The duty rate will be 20 cents per kilogram plus 7% ad valorem. The textile category designation is 659. Duty rates are provided for your convenience and are subject to change.
