Dear Ms. Wong: In your letter dated May 13, 2008, you requested a classification ruling. The submitted samples will be returned. Style PP 1066998 is an underwear camisole constructed of a sheer 92% nylon and 8% spandex open work knitted fabric. The lightweight undergarment features adjustable elasticized shoulder straps and covers the torso from the top of the bust to the waist. The undergarment is made up of raschel lace-like open work knitted fabric that has inwrought designs. The undergarment also features a scalloped V-styled front, seamed bust panels, side seams, and an overlock stitch finish at the bottom. You have submitted 2 samples of the same style in different colors (red and black). The applicable subheading for style 1066998 will be 6109.90.1065, Harmonized Tariff Schedule of the United States (HTUS), which provides for T-shits, singlets, tank tops and similar garments, knitted or crocheted: Of other textile materials: Women’s or girls’: Tank tops and singlets: Women’s. The duty rate will be 32 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
