Sproul Lois Sproul, CBH, Inc. 510 Plaza Drive, Suite 2250 College Park, GA 30349 RE: The tariff classification of a travel bag and duffle bag from China Dear Ms. Sproul: In your letter dated June 3, 2008 on behalf of EMS Innovations, Inc., you requested a classification ruling. The samples which you submitted are being returned as requested. The sample you referred to as a trauma kit bag was submitted without a style number. It is a multi-use travel bag constructed with an outer surface of 100% man-made textile material. It is designed to provide storage, protection, portability, and organization to personal effects or trauma supplies during travel. It secures with zipper closure along three sides and has a top carrying handle. The interior of the bag has two additional zippered compartments with a polyvinyl chloride (PVC) clear panel. Underneath one of the compartments are various sized open slot pockets. It measures approximately 9” (W) x 8” (H) x 3” (D). The sample you referred to as a master kit bag was submitted without a style number. It is a duffle bag constructed with an outer surface of 100% man-made textile material. It is designed to provide storage, protection, portability, and organization to personal effects. It has an unlined main compartment with no additional features. The bag has a top zipper closure and double webbed carrying straps. There are webbed handles at both ends of the bag for easy lifting. It measures approximately 27” (W) x 19” (H) x 20.5” (D). The applicable subheading for the two trauma bags will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sports, and similar bags, with outer surface of textile materials, other, of man-made fibers, other. The rate of duty will be 17.6% ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. HTSUS 4202.92.3031 falls within textile category 670. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
