Dept 733IMP-A3-366B Hoffman Estates, IL 60179 RE: The tariff classification of women’s jackets from Indonesia Dear Ms. Williams: In your letter dated May 27, 2008, you requested a classification ruling. Your samples will be returned as requested. Submitted sample, style #WH8AN-20045MI, is a woman’s jacket constructed from 97% polyester and 3% spandex woven fabric. The jacket extends from the shoulder to slightly below the waist and is composed of three panels. The jacket features a collar, ¾ length pleated sleeves, a full lining, a full front opening secured by three self covered buttons beneath a placket, two front pockets below the waist and a hemmed bottom. Submitted sample, style #WH8AN-20004MI, is a woman’s jacket constructed from 80% polyester, 10% acrylic and 10% wool woven fabric. The jacket extends from the shoulder to slightly below the waist and is composed of three panels. The jacket features a round neckline with a fabric drawstring tie, ¾ length sleeves with elastic cuffs, a full lining, a full front opening secured by five buttons (of which four are beneath a placket), two front pockets below the waist and a banded bottom. The applicable subheading for both styles will be 6211.43.0078, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of man-made fibers: jackets and jacket-type garments excluded from heading 6202. The duty rate will be 16 percent ad valorem. Duty rates are provided for your convenience and are subject to change. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
