Dear Ms. Samuel: In your letter dated May 13, 2008, on behalf of Mahco Inc., you requested a classification ruling. The submitted sample is a Style NG-RS-102 Rain Suit consisting of a rain jacket, pants and a drawcord tote bag constructed of a top and bottom layer of nonwoven polypropylene fabric that is laminated to a middle layer of polypropylene plastic, which is a fabric of heading 5603. The fabric is waterproof and breathable. The rain jacket features a collar with a pack-away hood, full front zipper closure, a storm flap with a 5-snap closure, two front slash pockets and elastic cuffs. The rain pants feature an elastic waistband and multi-snap leg openings. The storage tote bag is considered normal packaging. The applicable subheading for the Style NG-RS-102 Rain Suit will be 6210.10.9040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for garments made up of fabrics of heading 5602, 5603, 5903, 5906 and 5907: of fabrics of heading 5602 or 5603: other: other, other, other. The duty rate will be 16% ad valorem. Duty rates are provided for your convenience and are subject to change.
